Barometer Books
This Agreement outlines the terms under which Barometer Books Pty Ltd (ACN 675 376 431) (‘Barometer Books’) distributes books for sale to the Buyer on a wholesale basis.
- Books will be ordered by the Buyer via Barometer Books’ website. All book deliveries agreed to by Barometer Books will be provided subject to these terms.
- Barometer Books agrees to supply to the Buyer at the price reflecting the discount from the RRP (which shall be inclusive of GST) specified on Barometer Books’ website at the time an order is submitted by the Buyer.
- The delivery of books to the Buyer is the responsibility of Barometer Books.
- Barometer Books will provide the books bound and packaged individually in protective wrapping. Separate stickers will be provided specifying the ISBN of all books that can be affixed to the protective wrapping.
- Buyers who opt for full prepayment of a consignment order will be given priority in terms of order supply. A tax invoice will be sent to the Buyer following any prepayment of such an order. Any books sold on consignment that have been prepaid but remain unsold after 12 months can be returned to Barometer Books for a full refund of the price paid.
- Books which are ordered on consignment will be supplied on ‘Sale or Return’ terms once the Buyer submits its order via Barometer Books’ website and agrees to these terms.
- Books which are ordered and paid for on ‘firm sale’ terms are final and cannot be returned to Barometer Books. Barometer Books will provide a Tax Invoice to the Buyer at the time of purchase by the Buyer.
- The Buyer will advise Barometer Books of the number of books from a consignment order which have sold each month by the 25th day of each month. Barometer Books will then issue a Tax Invoice to the Buyer in respect of the sold books.
- Consignment books will be displayed by the Buyer for up to 12 months (or otherwise upon request by Barometer Books). After this time, unsold consignment books can be removed from the shelves and returned to Barometer Books. Barometer Books can require the return of unsold consignment books at any time.
- Once unsold consignment books have been removed from the shelves, the Buyer will contact Barometer Books to inform Barometer Books that the books are awaiting collection. The unsold consignment books must be in good and undamaged condition, and must be in their original protective wrapping. The packaging of unsold consignment books for return is the responsibility of the Buyer, and the collection of unsold books is the responsibility of Barometer Books.
- All stolen or damaged books, and all unsold books which have been removed from their protective wrapping, must be paid for in full by the Buyer at the same price as if such books had been sold. Barometer Books will send the Buyer a Tax Invoice in respect of such books
- Payment of Barometer Books’ Tax Invoice is to be made by the Buyer to Barometer Books’ bank account via Electronic Funds Transfer (EFT details will be set out in Barometer Books’ Tax Invoice) within 7 days of the date of the Tax Invoice.
- All books which have not been sold and paid for by the Buyer remain the property of Barometer Books.
